ERISA puts forth specific rules that must be followed by the insurance company. ERISA also has rules that must be followed by the individual seeking disability benefits. If a long-term disability claim is denied or terminated, ERISA gives you the right to appeal the insurance company’s decision. The appeal must be made directly to the insurance company.
