About 80 percent of group disability insurance policies provided through an employer are governed by ERISA. ERISA is the Employee Retirement Income Security Act of 1974. ERISA puts forth specific rules that must be followed by the insurance company. ERISA also has rules that must be followed by the individual seeking disability benefits. If a long-term disability claim is denied or terminated, ERISA gives you the right to appeal the insurance company’s decision. The appeal must be made directly to the insurance company.

It is important to know that the appeal of a denial or termination of long-term disability benefits may be your last chance to provide medical and nonmedical information to support your disability claim. Once a final decision is made by the disability insurance company, and it is a denial, no additional information can be added to your case. If your long-term disability appeal is denied, your next available legal step is to file a lawsuit in federal court.

Rhode Island Law

Under Rhode Island insurance law, no new or existing disability insurance policy can have language giving sole discretion to the insurance company to determine who can receive benefits. These are known as discretionary clauses. Rhode Island, and only a few other states, ban these clauses. That being said, not all disability insurance policies contain discretionary language.
