Liberty Terminates LTD Benefits for Client with Chronic Pain & No Improvement

Liberty approved our client’s long term disability benefits when he was diagnosed with crippling chronic pain. However, it would later terminate his benefits about five years later, despite there being no evidence of medical improvement of his condition. Details of the Chronic Pain Early Termination Case

In 2011, our client suddenly and quite shockingly experienced a right-ear bleeding that soon developed to severe pain in the right side of his face, as well as strong tinnitus and noise sensitivity. He sought treatments for this unusual and persistent medical condition, which seemed to be gradually worsening. No treatments were working well, and he eventually could no longer return to work due to the constant pain and suffering caused by his chronic pain.

Liberty initially approved his short term disability benefits as he continued to look for medical treatments and solutions. Less than a year later, Liberty reviewed his medical files and found he was disabled. The decision was made to approve his long term disability coverage for as long as he was not able to return to work.

Only five years later, with no medical improvement recorded by any of his treating physicians and specialists, our client’s LTD benefits were abruptly terminated by Liberty. When the termination was enacted, Dr. Sarantopoulo, who is leading our client’s medical care, wrote to Liberty to explain that there was no treatment or therapy that was making a positive, significant change in the chronic pain.
