Up until 2007, insurance companies had an unfair advantage in ERISA disability cases arising in Michigan. This is due to the fact that they had “discretion.” This meant that a federal judge could not rule in favor of the claimant unless the insurance company acted completely unreasonably in denying benefits.
This was a harsh standard to meet. It was not enough for a judge to find the individual was disabled. Indeed, a judge needed to find that there was no basis for the denial of benefits.
Michigan put an end to this insurance friendly rule. In 2007, Michigan banned discretion in disability insurance products. Effective February 2007, this ban applies to any insurance policy issued, advertised, or delivered to any person in Michigan.
