Details of the Veteran’s Back Pain Case
As an assistant manager for Walmart, our client had to be on her feet all the time, lift product often, and generally be in constant motion to some extent. Her back pain – worsened by bulging discs and fibromyalgia – caused her to struggle in her own occupation, and she became depressed because of it. She sought long term disability benefits from Liberty.
Liberty referenced U.S. Department of Veterans Affairs (VA) records to note the severity of her back pain and complications. It also used the evaluations of her VA psychologist, who warned that continued time in the workforce would only worsen her conditions, specifically her depression. Bizarrely, Liberty used these records and still chose to deny her claim to benefits.
Our attorneys also referenced her VA records to build the case against Liberty and in pursuit of deserved benefits. A note from June 2018 was of particular interest. It was from the VA, stating she had gained disability benefits from the Department due to her fibromyalgia, left knee strain, back pain, and so forth. If the trusted doctors of the VA found that our client was too disabled to continue work as normal, then how could it be that Liberty’s medical assessment found the exact opposite?
Attorney Burgos challenged Liberty’s decision in a pointed response, written and sent on behalf of our client. We are happy to be able to say the insurance company was convinced of the errors of its ways and did eventually approve our client’s LTD benefits.
