Lincoln Wrongfully Terminates LTD Benefits for Palm Beach Walmart Manager with Migraines

Dabdoub Law Firm Restores LTD Benefits for Florida Walmart Manager

In February 2023, Dabdoub Law Firm successfully reinstated our client’s long-term disability (LTD) benefits in Palm Beach, FL after they were wrongfully terminated by Lincoln National Life Insurance Company. Despite the wealth of evidence to support our Florida client’s disability, Lincoln nonetheless decided to terminate his benefits after paying them for two years.

Frustrated, our client turned to Dabdoub Law Firm for assistance. Read the full success story below.

Dabdoub Attorney Kevin Schaefer Appeals to Lincoln for Palm Beach Client

After our client’s insurer terminated his LTD benefits without cause, our fierce disability insurance lawyers wasted no time in exposing Lincoln’s egregious error. Attorney Kevin Schaefer, one of our knowledgeable Dabdoub attorneys, fought fiercely on our Florida client’s behalf to restore the benefits that were wrongfully taken from him.

“After paying [our client’s] LTD benefits for over two years, Lincoln terminated his benefits suggesting he is capable of full-time sedentary work,” Attorney Schaefer explains. “The records tell a different story.”

Our Florida client suffers from a constellation of medical conditions that continue to wreak havoc on his life, including:

  • Anxiety
  • Migraines
  • Spondylosis
  • Sleep apnea
  • Fibromyalgia
  • Gastroparesis
  • Adjustment disorder
  • Chronic pain syndrome
  • Bilateral ulnar neuropathy
  • Lumbosacral radiculoplexus neuropathy

Prior to his disability, our client enjoyed working as a Walmart manager. For over 15 years, he devoted himself to his job, excelling in every role with every intention—and likelihood—of continuing to climb the corporate ladder until his eventual retirement. Unfortunately, life had other plans.

By December 2019, our Palm Beach client was no longer fit to work. Lincoln acted in good faith by approving our client’s initial claim for LTD benefits, acknowledging his inability to work. This begs the question: why did they see fit to terminate his benefits a few short years later, given that there is still staggering evidence to support his inability to work?

Even after conducting a thorough review of the medical evidence, Lincoln saw fit to deny our Florida client the disability benefits he needs and deserves.

“Lincoln’s termination of [his] LTD benefits was wrong, unreasonable, and frankly cruel,” Attorney Schaefer admits, going on to highlight some key evidence of this unjust decision. In addition to copious medical evidence, our client underwent a functional capacity evaluation (FCE) that ultimately supported his inability to return to work, and an independent medical examination, during which his physician found “ample evidence to support the [LTD] claim.”

Fortunately, our experienced disability lawyers proved that Lincoln’s termination was unjustified and unreasonable, successfully appealing to restore the disability benefits that our Florida client rightfully deserved from the start.
