Details of the Fahr’s Disease Case

At only 41 years old, our Las Vegas client was diagnosed with Fahr’s disease, which was linked to her generalized anxiety disorder and depressive disorder.

With this all in mind, it is fair to say that our client’s disabilities caused by the condition are permanent and will only get worse with time. Medical Reviews Reveal Her Disability

In its denial, Lincoln argued that our client should be able to hold some sort of gainful employment but did not explain how that would be possible due to the severity and progressive nature of her Fahr’s disease. It seemed that the insurance company either failed to review or understand the medical information that detailed the disabling conditions caused by Fahr’s disease, including an independent functional capacity evaluation.

Perhaps the most noteworthy comment from the evaluation is: “[The client] is unable to perform the physical demands of any type of work including SEDENTARY work on a regular and consistent basis.”

Another thorough physical evaluation found that our client experienced these limitations and more:

  • Sitting up to a maximum of 30 minutes at a time, for up to 2 hours per day
  • Impaired sitting, standing, and walking tolerance
  • Squatting, kneeling, and climbing impairment
  • Difficulty maintaining concentration due to high levels of pain and headaches
  • Sensitivity to environmental triggers (light, noises, weather, etc.)
  • Balance impairment (fall risk)

Acting as if our client should have been able to hold gainful employment was plain wrong. With the promise of escalating the case to litigation that would surely cost Lincoln more in the long run, Attorney Burgos sent a challenge letter on behalf of our client.
