Details of the 2016 Stroke Case

Years ago, in 2016, our client suffered a stroke that debilitated him. He required occupational, physical, and speech therapy, but never fully recovered. He wanted to keep working, so he continued to try to meet the duties of his role as a National Account Manager for a major corporation. But as time went on, his health got worse, and he made more and more serious mistakes at work. Ultimately, he was practically forced to stop working and file for long-term disability benefits.

LINA understood the severity of his health problems and accepted his LTD claim. Yet it decided to cancel his benefits early. No new medical information showed that he had made an improvement or otherwise lost eligibility for the coverage.

Why did LINA end our client’s LTD benefits early? Attorney Burgos had to ask this question and sort through stacks of medical evidence, documentation, and communication to get to the truth. Whether it was a simple mistake or an intentional and unacceptable early cancellation, the result was the same: a man was left without the support he needed.

To challenge LINA’s decision, our legal team focused on medical details, which are difficult for insurance companies to refute. For example, a brain MRI in late 2025 showed various forms of brain tissue damage caused by the stroke that occurred years prior, but that were still causing significant physical and mental health problems. Shortly after the MRI, an in-person independent medical evaluation (IME), conducted by a triple-board certified MD, determined that he suffered from issues related to memory, balance, attention, and problem-solving, and that his health would likely only continue to decline with time; the IME included a conclusive statement from the doctor: “…[our client] is unable to return to any form of employment.” Specialists in sleep medicine, psychiatry, and neurology also contributed to his medical reviews, each determining that he should not be expected to complete work of any kind, as it would jeopardize his health and safety further.

After receiving the appellate demand letter from Attorney Burgos, LINA soon reversed its decision. We were able to get the benefits our client deserved without having to go to trial.
