Successful Appeal Reinstates Client's Long-Term Disability Benefits After Wrongful Termination

Dabdoub Law Firm is a team of long-term disability attorneys that can handle every part of a disability benefits claim, from filings and litigation to appeals in federal court. Our experience, insight, and extensive abilities recently proved incredibly useful once again, as we were able to successfully manage a complex appeals. Our client was originally given long-term disability benefits from The Guardian Life Insurance Company of America (Guardian) after she developed two chronic medical conditions, but the company unexpectedly terminated her benefits. We were able to convince them to reinstate the benefits by creating a thorough analysis of her disability, backed by an intelligently-gathered collection of medical evidence.

Details of the Guardian Disability Benefits Reinstatement Case

Our client was diagnosed with chronic hidradenitis suppurative (HS) and chronic migraines. Together, both medical conditions caused her to suffer chronic pain that made continuing work as normal unbearable. She has considerably limited range of motions from her conditions, making seated work, like that conducted in an office, also uncomfortable. HS manifests as painful sores and open cysts all over the body, which means even if it was not painful, she would experience crippling social anxiety from the embarrassment caused by being around others in such a state.

Guardian actually recognized the severity of her conditions and granted her long-term disability benefits after her initial filing. However, Guardian would later terminate her disability benefits early and based upon a secondary medical review conducted by a nurse case manager. It seemingly set aside the diagnoses of trusted medical professionals and the fact that her medical conditions had not improved at all since her claim was first approved.

Dabdoub Law Firm Fights for Our Client

Associate Attorney Bryn Natland of Dabdoub Law Firm led our work on this client’s long-term disability appeal. She and our team focused on the ample medical evidence our client had already obtained, as well as the errors in Guardian’s decision to terminate her benefits. In total, we submitted five separate medical records created in roughly six-months’ time, which all showed her HS was chronically painful and disabling. According to one Dr. Azmat, our client had to soak in an Epsom salt bath for one hour at least four times a day. This medical requirement alone should already be enough to warrant disability insurance benefits.

We are proud to be able to say that Guardian was convinced by our appeal case. After presenting the evidence of wrongful benefits termination and coming forth with a clearly composed argument, the insurance company reinstated the benefits owed to our client.
