If you are initiating your claim, insurance companies must make a decision within 45 days but can take two 30-day extensions for special circumstances (for a total of 105 days). If you are appealing a denial, insurance companies must make a determination within 45 days and may take one 45 day extension for special circumstances (for a total of 90 days).
Despite the stringent timelines imposed by law, insurance companies, including NYL, often find ways to extend those deadlines. Many times, it will involve additional requests for information where they “toll” or pause the clock on the review while you provide the information. While sometimes the requested information is truly necessary, many times it is not. It varies on a case-by-case basis.
