The results revealed that our client “is not employable on a full-time basis.” The notes add that our client “demonstrates fatigue with minimal activity” and requires “frequent breaks and change in positions.”

“Standing greater than 15 minutes resulted in extreme fatigue, perspiration and nausea,” the administering physician concluded, adding that our client was unable to complete the second day of her FCE due to joint pain and fatigue. “She was unable to complete 10 minutes of walking.”

In anticipation of the potential workarounds that many insurers seek to avoid paying out, the FCE test results even go as far as to establish the validity of the exam, explaining that our client “was consistent with all aspects of the evaluation, indicating a reliable evaluation” and her responses with the pain questionnaire were appropriate with no indication of symptom magnification.”
