Dabdoub Law Firm Challenges Wrongful Denial of Family Physician’s Long COVID Disability Claim in Maine

Our client worked as a family physician in Portland, Maine, for many years, but contracting COVID-19 in early 2021 would change his life forever. After a stay in the ICU, he suffered Long COVID which still debilitates him to this day. Ameritas didn’t agree he was disabled enough to get total disability benefits, though, so Attorney Geannina Burgos had to challenge the insurer head-on. We are pleased to say that Ameritas was convinced that his TD benefits claim was payable.

Details of the Physician’s Long COVID Case

When our client was in the ICU, it was only the start of his health problems. Long COVID would stay with him for years, making it impossible to continue working as a family physician due to debilitating complications that jeopardized the quality of care that he could provide his patients. He believed that he could use his total disability insurance policy provided by Ameritas, but was shocked when the insurance company argued he had no disabling physical or mental health conditions and that he voluntarily surrendered his practice but could have kept working otherwise.

Attorney Burgos took the lead in this case and got to work by gathering and analyzing his medical records. Quickly it became apparent that independent medical examinations (IMEs) and statements from his primary treating physicians clearly outlined how his Long COVID symptoms were disabling.

In one of the most recent medical evaluations, the treating provider said that he has “cognitive dysfunction syndrome as well as chronic post COVID-19 syndrome […],” which causes “long-term cognitive impairment […]” that is “almost irreversible and permanent in nature.”

To name only a few of the symptoms noted by this physician, our client has:

  • Marked difficulty with focus and concentration
  • Abnormalities with speech and language
  • Difficulty with train of thought and processing information
  • Alteration in memory and cognitive function

Pointing out the extent of our client’s disabilities and how they were clearly noted in his medical records, our team at Dabdoub Law Firm challenged Ameritas to make things right—or else meet our trial team in court. The insurer decided to back down before litigation became necessary. Not only were the benefits reinstated but backpay for past-due benefits were collected on behalf of our client.
