On April 24, 2020, Lincoln Life Assurance Company of Boston (Lincoln) denied an emergency room doctor’s request for leave under the Family and Medical Leave Act (FMLA) because he “did not submit and/or complete the required documents.” The doctor was only missing one (1) form and had recently been diagnosed with prostate cancer.
Upon this denied request, our Wilton, Connecticut-based client sought assistance from Dabdoub Law Firm. We were not only able to get his FMLA leave approved, but we also requested short-term disability (STD) benefits on his behalf.
Details of the ER Doctor’s Case
After being diagnosed with prostate cancer, our client realized he needed to take a step back from work and put his health first. He submitted a request for FMLA leave to Lincoln, so he could comfortably focus on his health for the first time in over 3 decades.
Our client was also struggling to move about the emergency room due to chronic pain and weakness in his right ankle. As a result of his symptoms, he was also experiencing problems with his mental health, poor sleep, weight loss, and loss of appetite.
All of these factors interfered with our client’s physical and mental capability to work in the emergency room, so Lincoln should have approved his leave of absence.
Because the company denied his request, however, Dabdoub Law Firm had to get involved.
Dabdoub Law Firm’s Involvement
When faced with Lincoln’s denial, our client recruited our firm. We quickly sent the missing form, which was completed by the physician overseeing our client’s many medical problems, along with letters explaining our client’s situation.
In addition to requesting approval for our client’s FMLA leave, we asked Lincoln for STD benefits, which our client was more than entitled to.
Fortunately, we received a timely approval of both. We are happy to have helped our hardworking client take time to focus on his physical and mental health.
