Our Experience with MetLife Disability Claims

In recent years, we have seen a trend where MetLife disability attempts to delay making claims decisions. This strategy extends the period of time that a person has to continue paying daily expenses without receiving their monthly disability benefit checks.

ERISA has specific guidelines that prohibit this type of delay. Under ERISA, an insurance company has 45 days to make an initial claim decision. Once you file an appeal, they have 45 days to make a decision. After the first 45-day period, they can take one 45-day extension. The extension period must begin at the end of the initial 45-day period.

But they would not begin counting that period until its doctor finished his review. This is not acceptable. An insurance company cannot choose when to start and stop the timer.
