Dabdoub Law Firm Restores MetLife LTD Benefits for Long Island Client

After MetLife wrongfully terminated her benefits in October 2021, our Long Island client turned to our disability insurance attorneys for assistance. Read the full success story below.

Our Disability Attorneys Appealed to MetLife on Our NY Client’s Behalf

In February 2023, Dabdoub Law Firm successfully restored the long-term disability (LTD) benefits that our New York client rightfully deserved from the start. Attorney Kevin Schaefer, one of our experienced Dabdoub attorneys, wasted no time in pointing out MetLife’s unjust error.

Even after paying our client’s LTD benefits for over 5 years, MetLife chose to wrongfully terminate her benefits despite the wealth of medical evidence to contradict it. To date, our New York client suffers from a constellation of serious medical conditions that cause her tremendous pain and disabled her from any occupation, including:

  • Sciatica
  • Cervicalgia
  • Fibromyalgia
  • Leukocytosis
  • Essential tremor
  • Chronic neck pain
  • Lumbar radiculopathy
  • Shoulder impingement
  • Cervicogenic headaches

Prior to her disability, our client enjoyed a fulfilling career as a banking analyst at Barclays. For years, she worked tirelessly to achieve professional success and excel in her role. Although she intended to continue ascending the corporate ladder until retirement, our client’s health took a turn for the worst, derailing her life plans and leaving her no choice but to apply for disability benefits.

Her insurer acted in good faith by reviewing the wealth of medical evidence and approving our client’s claim for long-term disability benefits in 2016. However, they terminated these benefits without cause in 2021, leaving our client confused, frustrated, and without the support she desperately needs—and rightfully deserves.

“The records have always shown Ms. X is disabled and incapable of returning to full-time work at any demand level,” Attorney Schaefer explains in a letter to MetLife. He goes on to cite some of the indisputable evidence against the insurer’s wrongful termination. This includes a functional capacity evaluation (FCE)—which, according to the courts, is “the best means of assessing an individual’s functional level.”

After undergoing an FCE in December 2022, the medical specialist concluded that our New York client is “unable to work at this time, at any capacity.” Although the FCE is arguably sufficient in itself, Attorney Schaefer pointed to the wealth of medical evidence to accompany those results, including numerous MRI scans showing worsening disc bulges and herniations—one of many factors that cause our client to suffer debilitating chronic pain.

“MetLife dismissed consistent evidence of disability in favor of paper-based reviews completed by paid consultants who have never met or even spoken with [our client],” Attorney Schaefer told MetLife, going on to remind them of their legal and ethical obligation to “act solely the interest of its beneficiaries” under ERISA law.

Fortunately, our disability insurance lawyers enlightened MetLife to the injustice of their wrongful decision, allowing our firm to successfully restore our client’s long-term disability benefits in Long Island, NY.
