“The records have always shown Ms. X is disabled and incapable of returning to full-time work at any demand level,” Attorney Schaefer explains in a letter to MetLife. He goes on to cite some of the indisputable evidence against the insurer’s wrongful termination. This includes a functional capacity evaluation (FCE)—which, according to the courts, is “the best means of assessing an individual’s functional level.”

After undergoing an FCE in December 2022, the medical specialist concluded that our New York client is “unable to work at this time, at any capacity.” Although the FCE is arguably sufficient in itself, Attorney Schaefer pointed to the wealth of medical evidence to accompany those results, including numerous MRI scans showing worsening disc bulges and herniations—one of many factors that cause our client to suffer debilitating chronic pain.

“MetLife dismissed consistent evidence of disability in favor of paper-based reviews completed by paid consultants who have never met or even spoken with [our client],” Attorney Schaefer told MetLife, going on to remind them of their legal and ethical obligation to “act solely the interest of its beneficiaries” under ERISA law.
