Dabdoub Attorney Successfully Appeals to LINA on Behalf of NJ Client

A disabled store manager in Trenton, NJ reached out to our Dabdoub lawyers after LINA denied him the short-term disability (STD) benefits he deserved. Fortunately, our advocates were able to right this wrong by appealing to LINA, reminding the insurer of its legal and ethical obligations under ERISA law.

Additionally, Dabdoub Attorney Kevin Schaefer successfully initiated a long-term disability (LTD) benefits claim on our NJ client’s behalf. “Here, LINA neglected its fiduciary duties owed to [my client], despite clear evidence of his disability and an inability to perform the material duties of his regular occupation as a store manager,” Attorney Schaefer concluded in his appeal.

Despite leading a successful career with Aldi, our Trenton client began to struggle in his physically demanding occupation—one that LINA recognizes as a medium-demand level job. It wasn’t until October 2022 that our client was forced to step back from his position, driven out of his work by the development and progression of significant pain.

The following month, our client was diagnosed with sciatica and low back with radicular symptoms. In addition to confirming his disability, his physician also confirmed various troubling symptoms that prevent him from returning to work, including severe pain, spasms, decreased range of motion in the lumbar spine, and difficulty bending, lifting, carrying, standing, and walking.

By January 2023, his physician confirmed that his patient’s condition had not improved. Our client went on to complete a Functional Capacity Evaluation (FCE) the following month, further establishing his disability.

“The medical evidence makes abundantly clear that [my client] cannot return to his medium-level occupation given debilitating physical limitations confirmed by his treating provider,” Attorney Schaefer concluded. “Given the overwhelming evidence that [he] has presented on appeal, LINA is afforded one final opportunity to once again conduct a full and fair review.”

Fortunately, LINA honored our firm’s request, justly instating the STD and LTD benefits our New Jersey client rightfully deserved from the start.
