Dabdoub Law Firm Successfully Appeals LTD Benefits from New York Life Insurance Company for Hawaiian Client Suffering from Trigeminal Neuralgia

A Woman in Decline

In February 2019, Ms. X woke up in terrible pain, and her life changed forever. Since then, she has struggled with ongoing pain, fatigue, dizziness, weakness, migraines, brain fog, and memory issues. Doctors diagnosed her with atypical trigeminal neuralgia, often called the “suicide disease” because of the severe pain it causes.

Ms. X's condition has grown worse since then, even with regular care from specialists. The chronic pain forced her to quit her job in February 2021. After that, she applied for disability benefits and received them.

On October 26, 2023, Ms. X's neurologist checked in on her health. His findings stated that Ms. X cannot work full-time. Her medical issues prevent her from even performing even a sedentary job.

The neurologist pointed out that:

  1. Ms. X suffers from trigeminal neuralgia, occipital neuralgia, and chronic migraines.
  2. Ms. X tried many treatments. She had injections, Botox, medication, and scans, but her severe pain persists.
  3. Trigeminal neuralgia and chronic migraines both cause intense, unending pain.
  4. Trigeminal neuralgia pain is sharp and crippling, and Ms. X suffers from these conditions.
  5. Ms. X's symptoms are permanent, and they stop her from working any job.

Later, a vocational consultant also reviewed Ms. X's ability to work. She confirms that since her last day of work, Ms. X has been unfit for her usual job or any other job.

A Decision Based on No Evidence

Despite clear proof of her condition, New York Life Insurance Company ended Ms. X's disability benefits. They relied on a single consultant's view. This doctor claimed Ms. X faces no limits or restrictions.

These findings go against all objective medical facts. They also contradict the insurer's previous agreement regarding Ms. X’s disability status. The doctor provided no medical justification for this conclusion.

This disregard for Ms. X’s extensive medical is unjust and unreasonable. Her ongoing severe pain highlights a dire need for support, and extensive medical records support this fact. Yet, the insurance company callously dismissed these critical details.

NYL’s actions leave Ms. X without necessary financial assistance. It also brings the company's practices into question. The company has ignored substantial evidence from multiple professionals. Moreover, it overlooks the real and debilitating nature of Ms. X's chronic conditions.

Furthermore, Ms. X had already appealed this decision, but NYL wouldn’t budge.

A Law Firm Putting Its Foot Down

When our firm discovered Ms. X’s unfair treatment, we acted immediately. We filed a second appeal on her behalf. This appeal was straightforward and strong. It highlighted Ms. X’s disability with clear evidence. We included both her extensive medical records and witness statements from Ms. X’s family. These statements supported her claim and revealed a personal depth of her daily struggles.

We communicated with NYL directly, and our message was firm. We demanded they reinstate Ms. X’s benefits quickly. Our team emphasized the urgency and necessity of their immediate action. Ms. X’s situation was dire, and the insurance company had to address it.

With tireless work, our firm was able to correct this obvious wrong. We stood with Ms. X and fought for her rights, and we put this unscrupulous company in its place.
