Dabdoub Attorneys Successfully Appeal to Lincoln on Behalf of Ohio Client

In July 2023, our disability insurance lawyers at Dabdoub Law Firm successfully appealed to Lincoln after they denied our client in Cincinnati the long-term disability benefits he deserves. Even after paying our Ohio client short-term disability (STD) benefits, his insurer saw fit to reject his application for LTD benefits, leading our experienced attorneys to reverse this unjust decision on our client’s behalf.

Attorney Kevin Probst, one of our seasoned Dabdoub lawyers, reached out to Lincoln to secure the LTD benefits that his client deserves, informing the insurance company that there is now even more medical evidence of long-term disability to meet the definition included in his policy.

According to the results of his client’s Functional Capacity Evaluation (FCE), a test that the courts consistently consider to be “the best means” of assessing functionality in disabled individuals, Attorney Probst reminds Lincoln of their ethical and legal responsibilities as an ERISA fiduciary—and more importantly, how they fail to meet those by denying his client the LTD benefits he needs.

“Significant and more than sufficient clinical evidence submitted with this appeal proves that [my client] was, and continues to be, disabled,” Attorney Probst says firmly in his appeal. “If the evidence is fairly and honestly reviewed, there can be only one conclusion: [My client] is disabled under the terms of the policy and therefore qualifies for LTD benefits.”

After undergoing numerous medical reviews by various physicians, our Ohio client was diagnosed with “severe impairments” in all tested domains, the greatest of which include chronic neck pain, failed back syndrome of the lumbar spine and cervical spine, lumbar degenerative disc disease with spinal stimulators implanted in 2018 and again in 2020, and the inability to maintain prolonged sustained positions (such as sitting).

Lincoln’s Denial of LTD Benefits Was Wrong & Unreasonable

Fortunately, Attorney Probst and our other seasoned disability lawyers successfully appealed to Lincoln on our Cincinnati client’s behalf, securing the disability benefits he rightfully deserved from the start and empowering him to lead the fullest quality of life possible.
