Even so, The Hartford did not take these factors into account before proceeding to wrongfully deny our client’s LTD claim. “[My client] lacks the capacity to perform the material duties of her occupation as a registered nurse or any occupation,” Attorney Probst stresses. “Significant objective and clinical evidence proves that [she] remains unable to perform the material duties of her own or any occupation. If the evidence is fairly and honestly reviewed, there can be only one conclusion: [My client] met and continues to meet the definition of disability, and is therefore eligible to receive her LTD benefits.”
