After receiving the initial evaluation, in which Dr. Lipkin confirmed that our client “is unable to perform any job-related activity secondary to pain that affects concentration and focus,” Sedgwick approved our client’s claim for STD benefits to go into effect on May 2, 2022 and expire on June 30, 2022.

Dr. Lipkin filed second and third evaluations that were subsequently denied by Sedgwick, even after the physician stated that his patient is permanently incapacitated. Sedgwick our client STD benefits despite copious medical evidence highlighting his chronic pain and swelling and an inability to walk. “You cannot imagine how much pain I tolerate every day,” our Newark client responded.

In November 2022, Dr. Victoria L. Londin conducted a neuropsychological assessment to determine the impact of our client’s condition on cognitive functioning. After completing the comprehensive assessment, she concluded, “From a neuropsychological perspective, and in the absence of valid contrary findings, there is objective evidence to support the claim that [the patient] cannot meet the demands associated with his professional employment.”
