Dabdoub Law Firm Secures STD Benefits for NJ Client
In December 2022, Dabdoub Law Firm successfully secured short-term disability (STD) benefits for our client in Newark, NJ. Despite thorough evidence and extensive medical documentation from reputable physicians, our client’s claim for STD benefits was wrongfully denied by Sedgwick, leading him to turn to our experienced disability insurance attorneys for assistance.
Dabdoub Law Firm successfully appealed on our Newark client’s behalf to instate the disability benefits he rightfully deserves.
Our Skilled Disability Attorneys Successfully Appealed to Sedgwick
Since suffering a severe polio infection as a child, our Newark client has been paralyzed from the waist down on the right side of his body. Despite this significant lifelong hardship, he has repeatedly and impressively defied the odds by achieving tremendous success in his academic and professional life.
After earning his doctorate in philosophy, our client accepted a well-respected position as a scientific director in 2008—an occupation demanding extensive cognitive abilities to decipher medical data. However, our client began experiencing peripheral nerve pain in 2011. Even after seeking treatment from numerous podiatrists, undergoing physical therapy, and taking prescription pain medications, our client’s condition did not improve, ultimately forcing him to step away from work.
Extensive medical evidence supports that our Newark client suffers from Post-Polio Syndrome, rendering him incapable of performing his day-to-day responsibilities in the professional sphere. Our client’s physician, Dr. William Lipkin, completed not one but three Disability and Leave Healthcare Provider Statements supporting his disabled patient’s inability to work.
After receiving the initial evaluation, in which Dr. Lipkin confirmed that our client “is unable to perform any job-related activity secondary to pain that affects concentration and focus,” Sedgwick approved our client’s claim for STD benefits to go into effect on May 2, 2022 and expire on June 30, 2022.
Dr. Lipkin filed second and third evaluations that were subsequently denied by Sedgwick, even after the physician stated that his patient is permanently incapacitated. Sedgwick our client STD benefits despite copious medical evidence highlighting his chronic pain and swelling and an inability to walk. “You cannot imagine how much pain I tolerate every day,” our Newark client responded.
In November 2022, Dr. Victoria L. Londin conducted a neuropsychological assessment to determine the impact of our client’s condition on cognitive functioning. After completing the comprehensive assessment, she concluded, “From a neuropsychological perspective, and in the absence of valid contrary findings, there is objective evidence to support the claim that [the patient] cannot meet the demands associated with his professional employment.”
Thankfully, Dabdoub Law Firm successfully advocated on behalf of our Newark client to reinstate the STD benefits he was rightfully entitled to, empowering him to live an improved quality of life by reversing Sedgwick’s unjust denial.
